Guaranteed Home Sale Program

Terms and Conditions

These terms and conditions (the "Agreement") outline the terms and conditions for the real estate sales promotion offered by Purple Acorn at Keller Williams Coastal and Lakes & Mountains Realty (referred to as "we," "us," or "our") guaranteeing that the property listed will be under contract within 7 days of being live in the Multiple Listing Service (MLS) or we will reduce our side of the commission in half. By participating in this promotion, you ("Participant" or "you") agree to be bound by these terms and conditions.

 

1. Promotion Guarantee:

   a. We guarantee that the property listed by the Participant will be under contract within 7 days from the date it goes live in the MLS.

   b. In the event the property is not under contract within the specified timeframe, we will reduce our side of the commission by half (50%).

 

2. Eligibility:

   a. This promotion is applicable to residential real estate properties listed by the Participant.

   b. The promotion is subject to the following exclusions:

      i. Commercial properties or properties zoned for commercial use.

      ii. Properties with unique legal or title issues.

      iii. Properties with existing contractual obligations or legal restrictions.

      iv. Properties located in areas where the promotion is prohibited by law.

v. Land listings or properties where 75% or more of the value is in the land value.

vi. Properties which do not pass FHA, USDA/Rural Development or VA lending.

 

3. Property Requirements:

   a. The property must meet all standard listing criteria as determined by us.

   b. The property must be accurately represented with complete and up-to-date information.

 

4. Commission Reduction Calculation:

   a. The commission reduction will be calculated as 50% of the commission agreed upon between the Participant and us.

   b. The commission reduction will only apply to our side of the commission, not the cooperating broker's side.
 

5. Promotion Procedure:

   a. Participation:

      i. To participate in this promotion, the Participant must enroll and accept these terms and conditions by signing the “Guaranteed Home Sale Promotion: Terms and Conditions” form prior to the property being listed in Multiple Listing Service (MLS).

      ii. By participating, the Participant acknowledges and agrees to the terms and conditions outlined herein.

   b. Listing Preparation:

      i. The Participant must ensure the property is evaluated, and a marketing strategy is developed to maximize exposure.

      ii. All necessary documentation required for listing preparation must be provided.

   c. Listing Activation:

      i. The property must be submitted to the MLS for listing activation.

      ii. Confirmation of the listing activation will be provided by us.

   d. Promotion Duration:

      i. The promotion will start on the date and time the property is listed in the Multiple Listing Service (MLS) and will end 7 days thereafter (168 hours)..

   e. Contract Submission:

      i. A contract must be submitted for the listed property within 7 days of the MLS listing going live. The contract does not have to be executed within the 7 days (168 hours).

   f. Verification Process:

      i. We will verify the contract submission date to determine eligibility for the promotion.

      ii. The Participant must provide any necessary documentation to verify compliance with the terms and conditions.

  g. Showing Process:

      i. Participant must allow any and all showing requests. Failure to allow a showing request may result in ineligibility of the Guaranteed Home Sale Program.

  h. Listing Price:

      i. The Listing Price will be selected by Purple Acorn at Keller Williams Coastal and Lakes & Mountains Realty.

  i. Commission Reduction Process:

      i. If eligible, we will notify the Participant of their eligibility for the commission reduction.

      ii. We will calculate the reduced commission amount and provide a revised commission agreement for both parties to sign.

      iii. The commission adjustment will be applied to our side of the commission and reflected in the final payment.
 

6. Exclusions and Limitations:

   a. Force Majeure: We shall not be held liable for any delays or failures in performance resulting from events beyond our reasonable control.

   b. Multiple Listing Service (MLS) Constraints: Any limitations imposed by the MLS or other governing bodies may affect the promotion's applicability.

   c. Property-Specific Limitations: Properties with specific characteristics or conditions may be subject to additional limitations or exclusions.

   d. Non-Compliance with Terms and Conditions: Failure to comply with these terms and conditions may result in disqualification from the promotion.
